These Terms of Service ("Terms") govern the use of the Brand Shop operated by LocalHeroBox GmbH ("LocalHeroBox") on behalf of SD Worx ("Customer"). By using the Brand Shop, you agree to comply with these Terms. If you do not agree with any part of these Terms, please refrain from using the Brand Shop.

  1. Product Orders and Customization: a. All orders placed through the Brand Shop are considered custom-made products, as they are produced and customized on demand. Due to the personalized nature of these products, refunds or returns are not accepted unless there is a manufacturing defect or an error made by LocalHeroBox. b. It is the responsibility of the customer to review and ensure the accuracy of the customization details provided during the ordering process. LocalHeroBox is not liable for any errors or discrepancies resulting from incorrect or incomplete customization information.

  2. Invoicing and Payment: a. After placing an order in the Brand Shop, customers will receive an invoice for the total amount due. Payment is required within 45 days from the invoice date. b. All payments must be made in the currency specified in the invoice.

  3. Intellectual Property: a. The Brand Shop, including its content, designs, and trademarks, is protected by intellectual property laws. All rights, title, and interest in the Brand Shop belong to LocalHeroBox or its licensors. b. You are granted a limited, non-exclusive, non-transferable license to access and use the Brand Shop for personal, non-commercial purposes. Any unauthorized use, reproduction, or distribution of the Brand Shop or its content is strictly prohibited.

  4. Limitation of Liability: a. LocalHeroBox strives to ensure the accuracy and functionality of the Brand Shop to the best of its ability. However, we make no warranties or representations regarding the availability, accuracy, or reliability of the Brand Shop. b. LocalHeroBox shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the Brand Shop, even if advised of the possibility of such damages.

  5. Privacy and Data Protection: a. LocalHeroBox collects, processes, and stores personal data in accordance with applicable data protection laws and our Privacy Policy. By using the Brand Shop, you consent to the collection and use of your personal data as outlined in the Privacy Policy.

  6. Modifications to the Terms: a. LocalHeroBox may update these Terms from time to time at its discretion. Any substantial changes to the Terms will be communicated through the Brand Shop or other appropriate means. b. Continued use of the Brand Shop after the changes to the Terms constitutes acceptance of the modified Terms.

  7. Governing Law and Jurisdiction: a. These Terms are governed by and construed in accordance with the laws of Germany. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.
